Terms of Service
1. Our Services
OTC Medicolegal provides independent specialist occupational therapy assessments, medico-legal reports and related professional services. Assessments and reports are completed by qualified, CORU-registered occupational therapists for use in legal, insurance and related matters. Services are undertaken following formal instruction and acceptance of an agreed scope of work, professional fees and timeframe.
2. Referrals and Quotations
All instructions must be submitted in writing, either by email or through our online referral form. A written quotation outlining the agreed scope of work and professional fees will be provided before services commence. No assessment or other professional work will commence until the quotation and terms of instruction have been accepted in writing by the instructing party.
3. Use of Reports
Medico-legal reports prepared by OTC Medicolegal are provided for use in connection with the specific matter for which they were commissioned. Reports may be disclosed to relevant parties as required for the conduct of those proceedings, but should not be used for an unrelated matter or purpose without the prior written agreement of OTC Medicolegal.
4. Expert Independence
Our occupational therapists act independently and objectively when providing expert opinion. Where acting as expert witnesses, their overriding duty is to the court and not to the instructing party. Nothing in these Terms and Conditions limits or affects their professional independence or their obligation to comply with applicable court rules, professional standards and duties governing expert evidence.
5. Payment Terms
An invoice will be issued upon completion of the assessment and preparation of the report. Payment is required in full before the final report is released to the instructing party. Reports will be issued promptly following receipt of payment.
6. Cancellation and Postponement
Where an assessment is cancelled or postponed with less than 48 hours’ notice, or the individual does not attend a scheduled appointment, a cancellation fee may apply. Any applicable fee will be outlined in the quotation. We will endeavour to arrange an alternative appointment at the earliest mutually convenient date.
7. Limitation of Liability
The information provided on this website is for general information only and does not constitute occupational therapy, medical, legal or other professional advice. OTC Medicolegal provides independent occupational therapy assessment and opinion based on the information available, the assessment undertaken, and the specific instructions received in each case. No particular clinical, legal or litigation outcome is guaranteed. Medico-legal reports are prepared for the specific matter and purpose for which OTC Medicolegal is instructed and should not be relied upon for unrelated purposes without appropriate review. While reasonable care is taken to ensure that information on this website is accurate and current, OTC Medicolegal makes no representation that all website content will be complete or applicable to every individual case. Nothing on this website creates a clinician-client, expert–instructing party or other professional relationship. Such a relationship arises only following formal instruction and acceptance by OTC Medicolegal.
8. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Ireland. Subject to any applicable mandatory legal requirements, the courts of Ireland shall have exclusive jurisdiction in relation to any dispute arising out of or in connection with these Terms and Conditions or the services provided by OTC Medicolegal.
9. Changes to These Terms
OTC Medicolegal reserves the right to update these Terms and Conditions from time to time. The current version will be published on this website. Unless otherwise agreed in writing, the terms applicable to a particular instruction will be those in effect at the time the instruction is accepted. Last updated: September 2026
